1. Who We Are

Sure Bet Media LLC (“Sure Bet Media,” “we,” “us,” or “our”) is a limited liability company organized under the laws of the State of Florida, United States. We provide marketing, lead generation, artificial intelligence visibility and automation services to businesses in the United States and Canada.

2. Scope of This Policy

This Privacy Policy explains how we collect, use, disclose, retain and protect personal information when you visit surebetmedia.com and its subdomains (including links.surebetmedia.com, which hosts our forms, scheduling pages and chat widget), when you contact us by telephone, text message or email, and when you use our services. We refer to these collectively as the “Services.”

This policy does not apply to the practices of any third party we do not own or control, and it does not apply to the separate privacy practices of our clients in relation to their own customers.

3. Information We Collect

3.1 Information you give us

  • Contact and business details — your name, email address, telephone or mobile number, business name and website address, submitted through our forms, chat widget, scheduling pages or by contacting us directly.
  • Communications — the content of emails, text messages, chat conversations and voice calls you exchange with us, including any information you volunteer during those exchanges.
  • Transaction information — where you purchase a product or service, the details necessary to complete that transaction. Payment card details are collected and processed directly by our payment processor and are not stored on our systems.
  • Consent records — the date, time, method and wording of any consent you give to receive marketing communications, together with the IP address and page address from which it was given. We keep these records to demonstrate compliance with applicable law.

3.2 Information collected automatically

  • Device and connection data — IP address, browser type and version, operating system, device type, language and time zone.
  • Usage data — pages viewed, time spent, links clicked, referring website, and the marketing campaign, source or medium that brought you to us.
  • Cookies and similar technologies — as described in Section 8.

3.3 Telephone calls and voice assistant interactions

We operate an automated voice assistant that may answer, place or handle telephone calls on our behalf. Calls to and from our published business numbers may be recorded and transcribed for quality assurance, staff and system training, record keeping, and to create a record of what was discussed. Where a call is recorded, we will tell you at the start of the call. If you do not wish to be recorded, you may end the call and contact us instead by email at [email protected].

You will be informed at the outset that you are speaking with an automated assistant. You may ask at any time to be transferred to, or contacted by, a person.

3.4 Information from other sources

We may receive information about you from business data providers, publicly available sources, our clients and referral partners, and from advertising and social media platforms when you interact with our advertisements. We combine this with information we already hold about you.

4. How We Use Your Information

We use personal information to:

  • provide, operate, maintain and improve the Services, including generating and delivering reports you request;
  • respond to your enquiries, schedule and conduct calls and meetings, and provide customer support;
  • send you transactional and service messages, such as confirmations, reminders and account notices;
  • send you marketing communications where you have given the consent required by law, and manage your preferences;
  • measure and improve the performance of our marketing, including attributing enquiries to the campaign that produced them;
  • detect, investigate and prevent fraud, abuse and security incidents, and protect our rights and the rights of others;
  • comply with our legal obligations, including record keeping obligations relating to consent for electronic messages.

5. Text Messaging (SMS) Program

This section applies to mobile telephone numbers you give us and to the text messages we send. It forms part of this Privacy Policy and should be read together with our Terms of Service.

No sale or sharing of mobile information. Sure Bet Media LLC maintains strict privacy practices to ensure that personal information, including mobile telephone numbers and text messaging consent, is not sold, shared, rented, released or traded to third parties or affiliates for marketing or promotional purposes. Mobile information is shared only with the service providers that help us operate our messaging program, such as our messaging platform and telecommunications carrier, and those providers are prohibited from using it for their own marketing purposes.

5.1 How you consent

We send marketing text messages only to people who have opted in. You may opt in by ticking the consent box on one of our web forms, by texting us first, or by giving your express agreement in writing or during a recorded call. Consent to receive marketing text messages is not a condition of any purchase. We keep a record of when, where and how each consent was given.

5.2 What we send and how often

Depending on the consent you have given, messages may include appointment confirmations and reminders, replies to your enquiries, service notices, report delivery, and marketing about services relevant to your business. Message frequency varies.

5.3 Cost

Message and data rates may apply to messages we send to you and to messages you send to us. These charges are set by your mobile carrier, not by us. Please contact your wireless provider for details of your plan.

5.4 How to stop messages

You may cancel at any time by replying STOP to any message you receive from us. After you reply STOP we will send one confirmation message and will not send you further marketing text messages. Opt-out requests are actioned promptly and, in any event, within the period required by applicable law. You may also email [email protected] asking to be removed.

5.5 How to get help

5.6 Delivery

Mobile carriers are not liable for delayed or undelivered messages. We cannot guarantee that every message will be delivered, and delivery depends on factors outside our control, including your carrier's network and your device.

6. Email Communications

We send commercial email only where permitted by law. Every commercial email we send identifies Sure Bet Media LLC as the sender, includes our physical mailing address, and contains a working unsubscribe link. Unsubscribe requests are actioned promptly and, for recipients in the United States, within ten (10) business days as required by the CAN-SPAM Act. You may also unsubscribe at any time by emailing [email protected].

Unsubscribing from marketing email does not stop transactional or service messages relating to a product or service you have requested or purchased.

7. Canadian Recipients — Anti-Spam Law

Where we send commercial electronic messages to recipients in Canada, we do so in accordance with Canada's Anti-Spam Legislation (CASL). We send such messages only where we have express or implied consent as defined by CASL, and we keep records of the basis, date and method of each consent. We recognise that implied consent expires after the period set by CASL and we cease sending on that basis when it does.

Every commercial electronic message we send to a Canadian recipient identifies Sure Bet Media LLC, provides our mailing address and a means of contacting us that remains valid for at least sixty (60) days, and includes a clear and free unsubscribe mechanism that we action within ten (10) business days.

8. Cookies and Tracking Technologies

We and our service providers use cookies, pixels, tags and similar technologies to operate our website, remember your preferences, understand how the site is used, and measure and target advertising.

  • Strictly necessary — required for the site to function, including security and bot-detection services provided by Cloudflare.
  • Analytics and performance — used to understand traffic and improve the site.
  • Advertising — including the Meta Pixel, which allows us to measure the results of our advertising on Meta platforms and to show ads to people who have visited our site. Meta may act as an independent controller of data it receives; see Meta's own privacy policy for details.

Most browsers let you refuse or delete cookies through their settings. Blocking some cookies may affect how the site works. You can also limit interest-based advertising through the tools offered by the relevant advertising platform and through your device's advertising settings.

9. How We Share Information

We do not sell your personal information. We disclose personal information only as follows:

  • Service providers — companies that perform services for us under contract, listed in Section 10. They may use personal information only to provide those services to us.
  • Professional advisers — lawyers, accountants and insurers, where reasonably necessary.
  • Legal and safety — where we are required to do so by law, subpoena or court order, or where disclosure is necessary to protect our rights, property or safety, or that of others.
  • Business transfers — in connection with a merger, acquisition, financing or sale of assets, subject to the acquirer honouring this policy in respect of information transferred.
  • With your direction — where you ask us to share information, for example with a partner or referral.

For the avoidance of doubt, and as stated in Section 5, mobile telephone numbers and text messaging consent are never sold, shared, rented, released or traded to third parties or affiliates for marketing or promotional purposes.

11. Data Retention

We keep personal information only for as long as we need it for the purposes set out in this policy, and then for as long as we are required to keep it by law.

  • Contact and enquiry records — for the duration of our relationship with you and for a reasonable period afterwards for follow-up and record keeping.
  • Consent and opt-out records — retained for as long as we operate our messaging and email programs, and afterwards as necessary to demonstrate compliance. Records of opt-out are kept indefinitely so that we do not contact you again in error.
  • Call recordings and transcripts — retained for a limited period for the purposes described in Section 3.3, and then deleted.
  • Transaction records — retained for the period required by tax and accounting law.

You may ask us to delete information we hold about you, as described in Section 13.

12. How We Protect Information

We use administrative, technical and physical safeguards designed to protect personal information against loss, theft, and unauthorised access, disclosure, copying, use or modification. These include encryption of data in transit, access controls limiting who within our organisation can see personal information, and contractual protections with our service providers.

No method of transmission over the internet or method of electronic storage is completely secure. While we work to protect your personal information, we cannot guarantee its absolute security.

13. Your Choices and Your Rights

13.1 Choices available to everyone

  • Text messages — reply STOP to any message, as described in Section 5.4.
  • Email — use the unsubscribe link in any marketing email, or email us.
  • Telephone — tell us on any call that you do not wish to be contacted again, or email us.
  • Cookies — manage these through your browser settings.

13.2 Access, correction and deletion

You may ask us to confirm what personal information we hold about you, to provide you with a copy, to correct it if it is inaccurate or incomplete, or to delete it. Write to [email protected] with enough detail for us to locate your record. We will respond within the time required by applicable law. We may need to verify your identity before acting, and we may decline a request where the law permits or requires us to keep the information.

13.3 Residents of Canada

If you are in Canada, the Personal Information Protection and Electronic Documents Act (PIPEDA), or substantially similar provincial legislation, gives you the right to access the personal information we hold about you and to challenge its accuracy. You may withdraw your consent to our use of your personal information at any time, subject to legal or contractual restrictions and reasonable notice; we will tell you what the consequences of withdrawal would be. If you are not satisfied with our response, you may complain to the Office of the Privacy Commissioner of Canada.

13.4 Residents of the United States

Depending on the state in which you live, you may have rights to know what personal information we collect, to request a copy or deletion of it, to correct it, and not to be discriminated against for exercising those rights. We do not sell personal information and we do not share it for cross-context behavioural advertising in the sense given to those terms by state privacy statutes. 14. Children's Privacy

Our Services are directed to businesses and are not intended for children. We do not knowingly collect personal information from anyone under the age of eighteen (18). If you believe a child has given us personal information, contact us at [email protected] and we will delete it.

15. Location of Processing and Cross-Border Transfers

Sure Bet Media LLC is established in the United States and is operated from British Columbia, Canada. Personal information we collect may be stored and processed in the United States, in Canada, or in another country where we or our service providers maintain facilities. Where information is transferred across borders, it may become subject to the laws of the receiving country, including lawful access requests by courts, law enforcement and national security authorities of that country. We take reasonable steps, including contractual measures with our service providers, to ensure that personal information receives a comparable level of protection wherever it is processed.

16. Third-Party Websites

Our Services may contain links to websites we do not operate. We are not responsible for the content or privacy practices of those websites, and this policy does not apply to them. We encourage you to read the privacy policy of every website you visit.

17. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will revise the “Last updated” date at the top of this page and post the revised policy at surebetmedia.com. Where a change materially affects how we use personal information already collected, we will take reasonable steps to notify you. Your continued use of the Services after a revised policy takes effect means you accept the revised policy.
